It depends on the builder. Each builder writes its own rules for buyers who register without an agent, and the answer sits in the guest registration card and the sales contract. Ask for both in writing before you sign anything. The sales rep in the Waxahachie model home works for the builder, not for you.
No. The sales rep is paid by the builder to sell the builder's homes at the builder's terms. That is a fair job, and it is a different job from representing you. Nobody in the model home works for the buyer unless the buyer brings their own agent.
I covered the same question for other corridor towns: does the builder's sales rep in Cedar Hill work for you, and why Red Oak buyers bring their own agent. The answer is the same in Waxahachie.
Do not assume it is too late, and do not assume it is fine. Builders handle first visits differently, so find out what you signed. Use this order:
If the builder's answer is unclear, send it to me before you sign. Builder contracts run long, and the registration language is easy to skip.
In many builder contracts the builder pays the buyer's agent from its own sales budget, so the buyer does not write a separate check. Whether that holds for your builder and your community is a contract question. Confirm it in the builder's paperwork before you rely on it.
The price inside a new build often carries costs you do not see on the sticker. Waxahachie impact fees put roughly $12,700 inside a new build price in 2026, based on City of Waxahachie Ordinance 3654 as covered in our August 26, 2026 post. See what the Waxahachie impact fees mean for your new build price.
Waxahachie buyers have more room to ask questions than the sticker price suggests. The latest published figures:
| Measure | Figure | Period and source |
|---|---|---|
| Waxahachie median sale price | $364,791 (down 5.2% year over year) | June 2026, Redfin |
| Waxahachie closed sales | 282 (up 42.2%) | June 2026, Redfin |
| Waxahachie median days on market | 61 | June 2026, Redfin |
| Ellis County median price | $425,000 (up 4%) | July 2026, NTREIS Monthly MLS Summary |
| Ellis County median days on market | 76 | July 2026, NTREIS |
Prices are softer in town while sales volume is up, which means builders compete with resale homes and with each other. That competition shows up in incentives, and incentives have to be written down to count.
Four things: the registration terms, the agent compensation terms, the incentive amount with its date and conditions, and whether the incentive requires the builder's preferred lender. If a lender is tied to the incentive, price the offer against an outside lender too. I am a loan officer with Envision Home Lending LLC (NMLS #689220), so I can run both for you side by side.
The free New Construction Buyer Guide walks through the questions to ask and the documents to collect before you sign with any DFW builder.
Usually not. Once the contract is signed, the representation terms are part of it. The time to settle this is before you sign, so ask for the registration language first.
Texas license holders give clients the TREC Information About Brokerage Services form, which explains who a license holder represents. Ask for it and read it. The form is linked in the footer below.
A visit by itself is not a contract. The registration card and any contract you sign are what carry terms, so read what you sign at the desk.
The builder sets the price. Whether the builder pays your agent, and how, is written in the builder's terms. Get that in writing and compare the total cost, not the sticker price.
Compare. A builder incentive tied to its lender can still cost more than an outside lender's terms. Get both quotes at the same time with the same loan terms.
